Todd Hasz was riding his Cannondale bicycle on Carolina Beach Road earlier this month when he was struck by an SUV.  The driver stopped and offered to take the bicycle to a nearby friend’s home as Hasz was being taken away in an ambulance (he suffered only minor scrapes, fortunately).
But, according to the driver, when the highway patrol arrived, they said that taking the bike could result in additional liability, so she left it at the scene.  Unfortunately, the HP left it at the scene, too, and it subsequently disappeared.
Thus, Hasz is considering suing the the North Carolina Highway Patrol for the value of his bike, claiming they should have taken it in, either as evidence or just impounded it, to keep it safe.  The HP, while stating they feel really bad for him, say that typically, owners of vehicles in an accident are responsible for towing or otherwise moving/recovering their property from the scene.
In this case, it seems like miscommunication was the largest culprit, but it does raise an additional concern if you’re riding solo and get into an accident…make sure you know where your bike will end up!
