Former Asheville Firefighter Gets Four Months For Shooting At Cyclist

Back in July, Asheville firefighter Charles Alexander Diez yelled from his moving vehicle at Alan Simons as Simons rode his bicycle along Tunnel Road pulling his son in a bike trailer and his wife following.

Diez apparently yelled that Simons was risking the child’s life by riding their bikes on that road, and when Simons approached the vehicle, Diez pulled out his gun.  As Simons walked away, Diez’s gun went off and hit Simons’ helmet, causing damage to his eardrum but otherwise (and fortunately) leaving him relatively unharmed.

On Thursday, Diez pleaded guilty to assault with a deadly weapon with intent to kill (the original charge was first attempted degree murder, but was changed because the event was not premeditated) and was sentenced to four months in prison, which could be increased to 15 to 27 months based on Diez’s behavior during the next 30 months.

Superior Court Judge James Downs said mitigating factors, including Diez’s excellent work history and lack of prior criminal records, was the basis for the lenient sentence.  Diez says he only intended to fire a warning shot, that he felt threatened because Simons reached into his car and grabbed his shirt (a claim Simons denies).

At first I was glad, because this jerk was found guilty. Then, I realized that this jackass shot at a cyclist, warning shot or not, and hit him in the helmet *while his child was there,* and now is only sentenced to 4 months? Four months? Are you kidding?

Remind me to find out the name of this guy’s attorney for the next time I need to fire a warning shot at a driver who cuts me off, or pushes me off the shoulder while I’m riding.

I could care less that he has “excellent work history,” he shot at a guy with a kid.

I’m a lawyer, cyclist, and gun-nut. Guns do not “go off.” People fire guns by pulling triggers. Thus, there is no such thing as “accidentally” discharging a firearm though negligent discharges happen startlingly frequently. This guy aimed and fired a handgun at a man who was walking away from him. The confrontation was over, and it could not be said that the shooter was in any reasonable fear of death or grievous bodily injury from the cyclist, whether or not the cyclist had grabbed his shirt.

The judge just likes firemen, I guess. What a stupid sentence.

This is absolutely crazy. Now every redneck and idiot with a gun that hates cyclists and has no clue what the laws says will,if they can read, be convinced that shooting people is the right thing to do! Let me guess, the Cyclist was a racist for being shot right?
